Deaf Wrestler Sues Over Interpreter Rules

VIDEO [CC] - Deaf News: A high school wrestler who is Deaf is suing MHSAA to have an interpreter with him on the mat.



DETROIT -- WXYZ - A Royal Oak High School wrestler who is Deaf has filed a lawsuit against the Michigan High School Athletic Association.



The senior at Royal Oak High School says he is Deaf, and that shouldn’t be a problem. It has become one during meets because the MHSAA is restricting his use of sign language interpreters.



“It is not fair,” said Ellis Kempf, of the rule.



Kemp says at meets sponsored by his school his sign language interpreter is allowed to move around the outside of the wrestling mat. At MHSAA sponsored meets that is not allowed. The MHSAA says the interpreter must be in Kempf’s coach’s designated corner. “That’s not going to work. I can’t see,” said Kempf.

“They are saying Ellis can have an interpreter he can’t see. He can have an interpreter if the interpreter stands behind his back. That does Ellis no good,” said Attorney Jason Turkish.



So why does the MHSAA have this rule?



The MHSAA says it is for the safety of interpreters. At tournaments there are often several wrestling mats lined up next to each other. While it is rare for wrestlers to go outside the boundaries and collide with each other as an official can stop the action, the MHSAA says an interpreter circling the mat likely would not see competitors from another mat coming toward her or him.



"The MHSAA allows and always has allowed interpreters for the Deaf in wrestling,” said Geoff Kimmerly, an MHSAA spokesperson. "This student has been competing in high school wrestling with the aid of an interpreter for three seasons. There are some limitations on where interpreters can move during competition, especially at large tournaments with multiple mats in close proximity, so the interpreter does not get in the way of coaches, officials and competitors. This is a safety concern. These accommodations have been used for other Deaf wrestlers without problems in the past."



Ellis says the only person getting hurt is him. He points to the fact his record shows he is more likely to win wrestling tournaments that allow sign language interpreters.



“There have been times I lost first place because I didn’t know what was going on,” said Ellis. Source

Deaf Protest Athens 2015 Live Video

Deaf News: Deaf Greek protests shouting "Give money to Providence Education, go get them from the plutocracy".





ATHENS - Thousands of disabled, chronically ill, parents and guardians with disabilities from across the country of Greece, and teachers in special education and mainstream schools gathered early in the afternoon in the center of Athens, participating in nationwide pananapiriko rally.



The mobilization involved the Coordination Committee Struggle Disabled, the Single Parents Association, Guardians of Disabled Attica, the Association of Workers Unit, Foundations, Schools Special Education, and the Deputy Initiative, demanding "No more mockery, teachers in all schools" as wrote their banners.





The demonstration was attended by the KKE MP Christos Katsotis.



The disabled and chronically ill gathered at Omonoia Square and made protest to the Constitution, shouting slogans such as "Give money to Providence - Education, go get them from the plutocracy" and "euro sacks to bankers, the Special schools were doing warehouses.'



The third memorandum the lowest disability pension is 87 euros, the retirement age for disabled workers go to 67 years and 50% reduction in the state budget expenditure on Welfare, leading to the closure of institutions by loading higher cost care to families. Moreover abolished and cut disability benefits and chronic sufferers and Special Schools close, imposed alimony.



Among other claims, the SEAAN: No cut in benefits and disability pensions, extending them to groups who do not get benefits, such as Deaf, Alzheimer. No pension below 600 euros unemployment benefit of 600 euros to all unable to work disabled, chronically ill and massive recruitment with constant work. No payment for drugs and treatments. Open all Special Schools in full operation, massive recruitment of permanent staff, to repeal the alimony. Source

Canadian 'Deaf Superintendent Now' Petition

Deaf News - Exclusive: Canadian protesters say Deaf students’ new superintendent who can hear must go - but not everyone agrees.





TORONTO STAR - A loud campaign advocating for a Deaf Superintendent circulated online and around the world, then didn’t get what it was fighting for.



The Provincial Schools Branch (PSB), which oversees the provinces four schools for the Deaf, announced last week it hired a hearing superintendent, Jeanne Leonard.



The announcement also said the branch hired Heather Gibson, who is Deaf, in a new position called “assistant to the superintendents.” Though that brings a Deaf person to an administrative level previously dominated by hearing people, some in the Deaf community say that’s not what they were asking for.



“It totally doesn’t make sense - there are qualified Deaf candidates,” Rose Etheridge, said through an interpreter at a protest Monday in front of the Ernest C. Drury School for the Deaf in Milton. “They’re trying to pacify us,” added Etheridge, whose Oct. 22 video calling for a Deaf Superintendent has hit 20,000 views. (The hashtag #PSBsuperintendent2015 followed the video and generated hundreds of posts from across the continent.)

Canada has not enacted a law similar to the US “21st Century Communications and Video Accessibility Act” which would provide an entitlement for Deaf citizens to access media online with mandated closed captioning. Without captioning, online content remains mostly inaccessible for us. In Canada, we are left out, falling behind the times in terms of modern accessibility; Technology changed and the rules didn’t. We have no clue what politician may say on videos or ads online. We are unable to watch any video online even ESPN, HBO, Netflix, MTV or our national new sites (CTV.ca or CBC.ca) because they choose not to provide closed captioning for some or all of its contents and are not required to do so.



Even more importantly, on the employment side, with all of the technological advancements available, communication barriers have been broken down. Today’s technology has revolutionized the workplace in terms of communications. With such a wealth of technology, incorporating the Deaf into a workplace environment should be fairly easy to do. You'd be thinking that it should have solved some of the unemployment issues, so did we!



In federal election 2015 that Justin Trudeau of the Liberal Party won the majority, we the Deaf note that none of the parties have addressed the issues of accessibility; none have developed any remedies for the issues facing the Deaf communities across this great country with exception of promising Accessibility Act but falling short of mentioning anything on our issues.

Dear Media: Stop Describing The Deaf As 'Mute'

VIDEO [CC] Deaf News: The phrase "deaf-mute" is problematic, and it is not an appropriate way to discuss a person.





Huffington Post by Lydia Callis - An unusual tale about a young Indian woman named Geeta has been making its way around the internet after a Bollywood film helped spark interest in her story. As a child, Geeta accidentally crossed the border into Pakistan all alone. She lived there in the care of a social welfare group for more than ten years years until last month, when she finally returned to India.





Geeta is Deaf and uses sign language to communicate, and the way the mainstream media has chosen to portray her is quite revealing. Major news outlets from CNN to CBS to Al Jazeera all decided to utilize the outdated terms "deaf" and "mute" in their stories about the woman.



For centuries, people with different abilities, intellectual skills or physical features were forced to live on the fringes of society. They were labeled "defective" or "freaks" by the mainstream, and their families were shamed by their existence.





These labels kept people isolated, and they opened the door for abuse and neglect. People who were Deaf were never even given the opportunity to learn or socialize. Deaf Woman Sues NYPD For Wrongly Arrested

VIDEO [CC] - Exclusive Interviews: Deaf woman arrested by NYPD settles case against city for $750,000.



NEW YORK CITY - A Deaf woman who said she was wrongly arrested by cops who ignored her disability settled her case for $750,000 Tuesday, a figure her attorneys say is the largest of its kind.



Diana Williams charged in her suit filed in Manhattan Federal Court that the New York City Police Department officers who slapped her in cuffs ignored police guidelines requiring them to request a sign language interpreter when interacting with Deaf people.



“Deaf individuals have rights, and they do not have to tolerate discrimination and injustices of any kind,” her attorneys Andrew Rozynski and Eric Baum said in a statement.



“Ms. Williams hopes that the settlement will send a message to all law enforcement agencies across the country that they should adopt proper policies and procedures to ensure full communication access for Deaf individuals.”



Two New Yorkers who can't hear or speak and communicate only by sign language claim they were wrongly arrested by NYPD officers in two separate incidents.



Williams’ ordeal began Sept. 11, 2011, when she called 911 for assistance evicting a difficult tenant from her Staten Island home.



Most of the people in the house were Deaf, but cops allegedly ignored training requiring them to request an interpreter.



Without being able to explain to Williams what was happening, Officer Christian Romano arrested her and the tenant for allegedly getting in a fight, and for the next 24 hours police ignored her attempts to communicate, the suit said.



Williams was so panicked she even wrote the letters “HOSP” on the window of a police cruiser in an effort to tell them she needed to go to the hospital, the suit says.



Romano checked the “No” box on the arrest report asking if an interpreter was needed, according to documents. He later checked “No” on different paperwork asking if Williams had a disability.



Williams’ attorneys, who run the Eisenberg and Baum Law Center for Deaf and Hard of Hearing, said they believe their client has received the largest payout ever to an individual alleging Deaf discrimination by a public agency. A Deaf advocate at the firm, Sheryl Eisenberg-Michalowski, also worked on the case.



“Settling was in the best interest of the city,” a Law Department spokesman said. Source by New York Daily News

Starbucks Sued For Discrimination Deaf Employee

Deaf News: Starbucks sued for allegedly discriminating against Deaf staff.





PHOENIX, AZ - The American Genius: Having a product that is in demand is vital, but maintaining quality help is the very bedrock of successful companies. A business, even the most reputable one, cannot make an impact without respectable, pleasant and reliable employees.



Regulars get used to seeing helpful, friendly faces and before you know it, instead of merely stopping by a coffee shop to grab your favorite cup of joe, a connection is made. Patrons become invested in the success of the company because they’re invested in the relationships they’ve fostered with the staff.

And so the cycle begins.



This is the type of emotional correlation that breeds success, but these connections can only occur when employees are valued and supplied the proper modifications at work. With that being said, shame on you, Starbucks.



Obviously, most of the adult world couldn’t function without their java, but that doesn’t give companies like Starbucks a pass on providing disabled employees proper accommodations.



Laura Roberts, a Starbucks employee for seven years, has filed a lawsuit against Starbucks. She claims that the store fired her in retaliation after she repeatedly asked for American Sign Language (ASL) accommodates.



Roberts, who has been Deaf since infancy, requested interpreters during staff and training meetings on various occasions.



She can read, and during her employment relied on a printed schedule for her hours. She also utilized her ability to lip-read in order to serve customers.



After a managerial transition, she was denied a printed schedule, and required to read her schedule from a posted list. Thus, limiting her ability to understand the hours she was required to work... Deaf Man Jailed Without Interpreter, Wins Case

Deaf News: Deaf man jailed without sign language translator wins case against District of Columbia jail.



WASHINGTON - A Deaf man who was jailed for 51 days without a sign language translator - left unable to communicate with prison doctors, his counselor, his teachers and other inmates - has won a discrimination case against the District of Columbia.



William Pierce is profoundly Deaf and communicates with sign language. After he pleaded guilty to a simple assault charge stemming from a domestic dispute, he was sentenced to the D.C. Correctional Treatment Facility, which is operated by Corrections Corporation of America.



The jail assumed that "lip-reading and exchanging written notes would suffice," and did not provide a translator, the court found.



"They figuratively shrugged and effectively sat on their hands," the court's decision read. Pierce felt isolated and confused by what was happening in jail, he said in court filings.



The court found that the District and CCA had violated the Americans with Disabilities Act (ADA), as well as the 1973 Rehabilitation Act.



“I am very pleased with Judge Jackson’s decision to find that the District of Columbia violated my rights as a Deaf man and a human being,” Pierce said, through an interpreter, in an American Civil Liberties Union press release.



Video phones and interpreters are critical for the Deaf and Hard of Hearing inmates to have access to the same opportunities as other inmates," Pierce said. Cochlear Controversy Dramatized In ‘Sound’

Deaf News: The world-premiere play “Sound” explores the controversy over cochlear implants for the Deaf.





SEATTLE TIMES - To hear? To speak? To sign? Those are the questions.



Deaf children in America are eligible for a procedure that can significantly expand their ability to hear. It is a cochlear implant, and rather than amplify sounds like hearing aids do, it works by directly stimulating the auditory nerve in the brain.



By 2012, about 96,000 adults and children in the U.S. alone had undergone the procedure.



Yet while many have hailed it as a breakthrough that not only can turn up the volume but also help Deaf children develop speech, not everyone is cheering.



“There are a lot of emotional feelings about CIs (cochlear implants) in the Deaf community,” explained Howie Seago, a Deaf Tacoma-bred theater artist and co-director of the new play “Sound,” which debuts this week at ACT Theatre.



“Many Deaf people feel that the doctors and other ‘professionals’ in the field of deafness consider us ‘defective’ and need to be fixed,” Seago commented by email.



“They stress this ad nauseam to the parents and do not fully educate them as to the range of communications options available. They almost always leave out the benefits of using sign language with their Deaf child.”



The conflict over whether children in particular need the device intrigued Seago’s co-director, Desdemona Chiang, when she read an early draft of hearing playwright Don Nguyen’s drama, “Sound.” It portrays the heated dispute between a Deaf father and his non-Deaf ex-wife over whether to try to restore their daughter’s hearing with CIs... Alumni of Illinois School for the Deaf, along with the Deaf community in the State of Illinois, would like to express our concerns with Illinois School for the Deaf (ISD) administrators and hearing faculties’ oppression towards Deaf Educators and other employees at ISD. Deaf employees of ISD experienced tremendous Discrimination and Oppression by hearing administrators and faculty over the years.



More than five families with multiple Deaf children left ISD because their parents were concerned about the well-being of their children and their success in education. The environment on ISD campus is not healthy nor is it a positive experience for Deaf students due to obvious discrimination and oppression of Deaf employees. Deaf Protest Rally At The White House In D.C.

WASHINGTON - Deaf protest rally will be held on September 5th and 6th 2015 at the white house in Washington DC. The protest is all about unemployment, discrimination, civil rights and language barriers in the United States. Here's the information of the location, time, meet, trip, and employment statistics.



The White House announces a new location for the protest area at the Ellipse Park, instead the Lafayette Square due to the renovation. Up to 20,000 Deaf people gathering at the park at 10 am - 4 pm - as seen on the map: Here.



This is an explanation on the base of erroneous information on the percentage of Deaf unemployment. Reading and understanding statistics are complicated. It's imperative to be critic of any research or papers with numbers: 2014 Disability Statistics Annual Report.





Gallaudet Report - There are some statistics investigating the employment rate of working-age individuals with hearing loss in the United States. The statistics for 2013 are made available in the Disability Statistics Compendium, specifically Table 2.3. The data within Table 2.3 is based on data from the 2012 American Community Survey from the Census Bureau.

Deaf News: Deaf worker whose job offer was rescinded wins bias appeal.





Business Insurance - Deaf employees are allowed to use alternate alerting devices to perform their job, says an appeals court that reversed a ruling Monday in favor of a Deaf job applicant who had a job offer rescinded after being offered the position.



Kelly Osborne filed a lawsuit in U.S. District Court in Cheyenne, Wyoming, against BioLife Plasma Services, a blood collecting facility located in Cheyenne that operates under Deerfield, Illinois-based Baxter Healthcare Corp. Ms. Osborne’s case stated the company violated the Americans with Disabilities Act (ADA), which prohibits employers from discriminating against a qualified individual on the basis of disability.



Ms. Osborne, who is Deaf but can read lips, applied for a plasma center technician position that required monitoring the donor area’s plasmapheresis machines that remove blood from a donor, separate the plasma and return the red blood cells to the donor. The machines emit audible alarms when something goes wrong. She was offered a position, but BioLife’s human resources department determined Ms. Osborne was not qualified, and the offer was rescinded, according to court documents.



The District Court decided May 30, 2014, that Ms. Osborne did not identify reasonable ways that she could monitor the donor blood machines using other methods to alert her and granted summary judgment to BioLife... Read more: http://businessinsurance.com/article/news

WASHINGTON - President Obama engages with youth with disabilities at the White House last a few years ago that failed the community opportunities. Deaf Protest will be held on Sept 5th, 6th, 2015 at the White House. It's all about unemployment for the Deaf and language barriers in the United States.

Deaf communities are ignored by government and Deaf unemployment is very high. The percent of unemployment (80%) seems closer to accurate for anyone who born Deaf but it should be lower as 70%.



Deaf unemployment is very complicated - they don't count anyone who born Deaf or HoH that goes through the Deaf Education, but late deafened with full oral language have better chance to getting hired, especially if they have very good benefit with cochlear implants or hearing aids and don't use VR service.



Deaf protest to rally the front of White House and the President Barack Obama will heard us the DEAF people that stand and shout "WE WANT JOBS!"
